Terms of sale

Updated on 19 Aug 2026

In force as of 18 August 2026.

1. Purpose

These terms govern the sale by Paul Leborgne EI ("the Publisher") of access to the Publium service ("the Service") to any person who subscribes to it ("the Customer").

Subscribing means accepting these terms in full.

The Service is for businesses only (retailers, craftspeople, companies and sole traders) subscribing for the purposes of their business. It is not offered to consumers within the meaning of the French Consumer Code.

2. Publisher identity

Paul Leborgne EI, a French sole trader, registered office at 6 bis boulevard Berthelot, bureau 3, 34000 Montpellier, France, SIREN 921 138 251. Contact: [email protected].

3. The Service

Publium is an online service that produces editorial content with the help of artificial intelligence: blog articles, product descriptions and CMS pages for online stores. Depending on the plan, it can connect to one or more stores to publish the content the Customer has approved.

The Service is supplied as the features stand on the day of subscription. The Publisher may develop it further; it will not remove a substantial feature from a running plan without notifying the Customer beforehand.

The AI produces a draft, the Customer reviews and approves it. The Service publishes nothing the Customer has not approved, and the Customer remains responsible for what is published.

4. Account

Accounts are created and subscriptions taken out on app.publium.fr. The Customer warrants the accuracy of the information provided and is responsible for keeping credentials confidential.

The Customer declares, on subscribing, that it is acting as a business for the purposes of that business, and provides its SIREN number or intra-EU VAT number for that purpose. The Publisher may refuse or terminate a subscription whose business status is not established.

5. Plans, prices and quotas

Plans and prices are those shown on the pricing page on the day of subscription. Prices are in euros. As the Publisher falls under the French small-business VAT exemption, no VAT is charged (article 293 B of the French General Tax Code). Should the Publisher become liable for VAT, it would be added to the displayed prices from the first renewal following notice to the Customer.

Each paid plan allows a number of content items generated per month (articles, product descriptions, CMS pages) shared across every store on the account. Refining content that has already been generated does not count against the quota.

The quota resets at each monthly renewal and does not carry over. Once it is reached, generation stops until the next renewal or until the Customer moves to a higher plan; content already produced remains accessible.

The Publisher may change its prices. Any change is notified at least thirty days before it takes effect and applies only to later renewals. A Customer who does not accept it may cancel under clause 7.

Moving up a plan takes effect immediately: the difference is calculated pro rata to the days remaining and charged at once. Moving down a plan takes effect at the next renewal; the difference is not refunded for the current month, and the quota stays that of the former plan until then.

6. Payment

Payment is by bank card, on subscription and then at each monthly renewal by automatic debit. Payments are processed by Stripe; the Publisher stores no card details.

If a payment is declined, generation features are suspended after a grace period of seven days. Content already published in the Customer's store is unaffected by that suspension.

7. Term and cancellation

The subscription runs for one month and renews automatically, with no minimum term.

The Customer may cancel at any time from the account. Cancellation takes effect at the end of the current monthly period, which has already been paid for and remains payable. No refund is given for the period under way, as set out in article 8.

The Publisher may terminate if the Customer breaches these terms, after a formal notice left unanswered for fifteen days, or without notice in the event of unlawful use.

8. No refunds

The subscription is not refundable, in whole or pro rata, whatever the reason given: cancellation, a closed account, an unused quota, a change of mind, dissatisfaction with the result, or not using the Service during the period paid for. The month under way remains payable.

The reason lies in the product: the monthly quota is available from day one, and each generation consumes a resource the moment the Customer asks for it. Refunding a month under way would mean refunding content already produced and, usually, already published. The short month with no minimum term is what pays for this rule, and it is why the Publisher offers no annual commitment.

Unused quota does not carry over and is not compensated. On cancellation it is lost.

A billing error is not a refund. An amount charged without being owed should never have left the account, and the Publisher returns it in full. Two cases, and only these:

  1. a double charge or an error in the amount;
  2. a charge after a cancellation recorded before the renewal date.

Requests go to [email protected] from the account's email address, with the reference of the invoice concerned. The Publisher returns the amount to the original payment method within five working days.

9. No right of withdrawal

The fourteen-day right of withdrawal under articles L221-18 et seq. of the French Consumer Code belongs to consumers. As the Service is for businesses subscribing for the purposes of their business (article 1), the Customer has no such right, and no waiver is asked of them at the point of payment.

By accepting these terms, the Customer acknowledges acting as a business for the purposes of that business. They may cancel at any time under article 7, and cancelling gives no right to a refund (article 8).

10. Ownership and warranties of generated content

Content generated by the Customer through the Service belongs to the Customer from the moment it is produced. The Publisher claims no intellectual property right over it. It may be used freely, including after the subscription ends, and content already published in the store stays there.

The Publisher warrants neither the accuracy, nor the originality, nor the compliance of generated content with any particular regulation. A language model produces plausible text, not verified text. The Customer reviews every piece before publishing and remains solely responsible for what they publish, in particular claims made about their products, the disclosures their sector requires, and third-party rights.

For the duration of the subscription and solely in order to provide the Service, the Customer grants the Publisher the right to host and process catalog data and the content produced.

The PrestaShop blog module remains free to use, independently of any subscription.

11. Availability and maintenance

The Publisher takes reasonable steps to keep the Service available, without guaranteeing uninterrupted operation. Scheduled maintenance is announced in advance where it is likely to interrupt the Service.

The Service depends on third parties, in particular AI model providers and the hosting provider. Unavailability attributable to one of them is not a breach by the Publisher.

12. Customer obligations

The Customer must not use the Service to produce or distribute unlawful, defamatory, infringing or misleading content, nor circumvent the Service's technical limits, quotas included.

The Customer alone is responsible for reviewing, for the accuracy of, and for publishing the content they approve.

13. Liability

The Publisher is liable for direct damage caused by its proven fault. Its liability is capped, across all damage combined, at the amounts actually paid by the Customer during the twelve months preceding the triggering event.

The Publisher is not liable for indirect loss, in particular loss of revenue, traffic or search engine rankings. How a piece of content ranks depends on factors outside the Publisher's control.

These limits do not apply in cases of wilful misconduct or gross negligence.

14. Warranties

The Customer has the benefit of the warranty against hidden defects under articles 1641 et seq. of the French Civil Code, and of the Service conforming to the description given in these terms and on the pricing page.

Warranties specific to the French Consumer Code, which are reserved to consumers, do not apply.

15. Personal data

Processing of personal data is described in the privacy policy.

16. Complaints

Complaints should be sent in writing to [email protected]. The Publisher replies within the time stated in article 8 and looks first for an amicable solution.

As the Service is for businesses only, the consumer mediation scheme under article L612-1 of the French Consumer Code does not apply to such disputes.

17. Applicable law and jurisdiction

These terms are governed by French law.

Failing an amicable settlement, disputes fall to the courts having jurisdiction under ordinary rules.

18. Changes to these terms

The Publisher may amend these terms. The Customer is informed of any substantial change at least thirty days before it takes effect and may cancel if they do not accept it. The terms that apply are those in force on the date of each renewal.
